Montreal, --- Friday December 17th, 2004 --- Osama Saleh a Palestinian refugee from the West Bank city of Tulkarem, won an important victory in his ongoing struggle against deportation from Canada. The Federal Court of Canada has issued a ruling directing Citizenship and Immigration Canada (CIC) to re-evaluate their decision to deport Osama Saleh, due to the "risk of persecution, torture and cruel & unusual punishment", which he would face if deported from Canada to the Israeli military occupation of the West Bank. The positive Federal Court decision opens the door for Osama Saleh to win his struggle for STATUS in Canada, as now Immigration Canada has been directed to review his case.

Osama Saleh's struggle against deportation and for STATUS in Canada began with his arrival at the US / Canada, Lacolle border crossing near Montreal in 2001. After arriving in Montreal, AND claiming refugee status in Canada, his refugee claim was refused and deemed "not credible" by the Immigration and Refugee Board (IRB). The refusal of Osama Saleh's refugee claim in 2001 highlights an ongoing and consistent pattern on the part of Citizenship and Immigration Canada and the IRB to refuse the refugee claims of stateless Palestinians.

The recent ruling from the Federal Court of Canada, illustrates the power of the collective organizing of Palestinian refugees against deportation. As the Coalition Against the Deportation of Palestinian Refugees, directly effected refugees have been struggling against Immigration Canada's efforts to deport members of the Palestinian community in Montreal. Osama Saleh's struggle against deportation from Canada to the illegal Israeli military occupation has come to symbolize the broader struggle of 100 stateless Palestinian refugees fighting against deportation from Canada.

The struggle against Osama Saleh's deportation highlights the seamless link between the struggle of Palestinian refugees in Montreal against deportation and the broader struggle for Palestinian freedom and liberation throughout the world. During the first Intifada, Osama was incarcerated for his participation in the Palestinian popular uprisings against Israeli occupation, which formed the main basis for his refugee claim in Canada. It is through Osama's experience of resistance to Israeli occupation and his active role in the struggle against Palestinian deportations from Canada, that he presents a living face of the Palestinian struggle for justice in Montreal.

Despite Osama's victory in the Federal Court of Canada, the struggle against Palestinian deportations continues. As Osama Saleh's case now stands for review by Immigration Canada, it is critical that we continue to assert political pressure to ensure that no deportations of Palestinian refugees take place.
